Acceptance of Terms

These Terms of Use disclose the terms and conditions for the websites www.e-telequote.com and www.easymedicare.com (collectively, this “Site”). This Site is provided to you (“you” or “your”) by e-TeleQuote Insurance, Inc. and its affiliates (collectively, “e-TeleQuote,” “us,” “we” or “our”).

By accessing and using this Site and its various pages, you agree to be bound by these Terms of Use, as well as the easyMed Online Privacy Policy (collectively referred to as these “Terms of Use”). About This Site

e-TeleQuote specializes in providing insurance quotes and connecting insurance shoppers with insurance carriers and professionals who can assist them. This Site provides users with online Medicare Advantage, Medicare Supplement, Prescription Drug plan price comparison and drug substitution technologies and databases to help consumers select an appropriate plan and save on their healthcare costs. This Site may also include other health and life policies from time to time. Additionally, this Site provides a wide selection of health information and materials to assist users in researching healthcare options. These offerings and services are hereinafter referred to as “the Service”. The plan comparison quotes and other health information furnished on this Site and any interactive responses are not intended to be professional advice and are not intended to replace personal consultation with a qualified physician, pharmacist or other healthcare professional.

We do not give medical advice, nor do we provide medical or diagnostic services. Medical information changes rapidly. Neither our content providers nor we guarantee that the content of this Site covers all possible insurance plans, participating doctors, prescription drug information, directions, precautions, drug interactions, or adverse effects that may be associated with any medical treatments or health problems that you may be experiencing.

Your reliance upon information and content obtained by you at or through this Site is solely at your own risk. Neither we nor our content providers assume any liability or responsibility for damage or injury (including death) to you, other persons or property arising from any use of any product, information, idea or instruction contained in the content or services provided to you.

Personal and Noncommercial Use Limitation

In consideration of your use of the Services, you agree to provide true, accurate and current information about yourself as prompted by the required registration forms. This Site is for your personal, noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or service found on or obtained from the Site.

This Site contains and references trademarks, patents, trade secrets, technologies, products, processes and other proprietary rights of e-TeleQuote. This Site, including, but not limited to, the source and object codes, logic, all graphical and navigational elements, the compilation, arrangement, structure, and sequence of all components, all content and applications, and the information on this Site, including, but not limited to, text, data, “look and feel” audio elements, videos, images, and pictures, regardless of the form or media in which the original or copies may exist, is the sole and exclusive property of e-TeleQuote and its licensors. No license or right to or in any trademarks, patents, trade secrets, technologies, products, processes and other proprietary rights of e-TeleQuote and/or any third parties is granted to or conferred upon you. You may not reproduce, copy, transmit, sell, sublicense, display, distribute, publish, broadcast, circulate, modify, create derivative works of, disseminate, or commercially exploit any portion of this Site or any information provided on this Site in any manner (including in electronic, print or other media, whether now known or hereafter developed) without the express written consent of e-TeleQuote. e-TeleQuote may enforce its intellectual property and proprietary rights to the fullest extent of the law, including seeking civil remedies and criminal prosecution.

The Site may contain technical inaccuracies or typographical errors or omissions. e-TeleQuote reserves the right to make changes, corrections and/or improvements to the Site, and to the products and programs described in such information, at any time without notice. The Site is offered at the sole and absolute discretion of e-TeleQuote, which further reserves the right to terminate the Site or any portion thereof at any time without notice.

Available Services

The purpose of the Site is to provide you with the ability to receive comparative insurance quotations from a network of insurance agents, brokers and other licensed insurance providers (hereinafter “Providers”), based on the information you have provided. These Providers may have one or numerous companies from which they will provide you with quotes. Once you have provided us with the information needed, by sufficiently completing an appropriate online form, we will refer that information to these Providers, who may then contact you directly if they are able to provide you with a quotation for insurance coverage. From time to time, these Providers may ask for additional information they may need to obtain an accurate quote. In the event that we do not have sufficient participation on our network in your area, you may receive less than five offers.

We do not guarantee that any of the Providers to whom we may forward your information will contact you or agree to provide you coverage. We are not responsible, in any way, for the conduct of the Providers to whom we forward your insurance quotation requests. If you need personal advice, explanation of coverage, assessment of needs or specific policy recommendations, consult with a licensed insurance agent, broker, or other qualified professional.

We reserve all the rights to our Site contents and may, at our sole discretion, change the contents of the Site, restrict access to certain sections of the Site, or discontinue any aspect of the Site, including, but not limited to, content, features, and hours of availability, without notice or penalty.

Your Use of The Service

You must be at least 18 years of age to use the Service. You warrant and agree that, while using the Service, you will not do any of the following:

Governing Law

All matters arising out of or related to the Site and/or these Terms of Use, or the enforcement or construction of these Terms of Use, shall be governed by, and construed and enforced in accordance with, the laws of the State of Florida, U.S.A., without regard to any conflict of law principles that would result in the application of the laws of a different jurisdiction. Any suit, action or other legal proceeding arising out of or relating to these Terms of Use and/or the Site shall be brought and adjudicated only in a court of competent jurisdiction located in Pinellas County, Florida, and you hereby consent to and waive any objection to the personal jurisdiction and venue of such court in any such suit, action or other legal proceeding.

Submissions

Any idea, feedback, suggestion, concept, know-how or technique, pictures, videos, audio material, graphics, maps, text or information submitted to e-TeleQuote (via this Site, by email or otherwise) (collectively, “Submissions”) shall be deemed and remain the property of e-TeleQuote, and e-TeleQuote shall be free to use such Submissions in any way, at any time and for any purpose, without any obligation to you or restriction of any kind, including, but not limited to, any confidentiality, payment, attribution or similar obligations, except as expressly agreed to in writing by the e-TeleQuote entity having the direct customer, contractor or other relationship with you or as otherwise required by law.

Indemnification

You agree to indemnify, defend and hold harmless e-TeleQuote (including its affiliates and its and their respective directors, officers, employees, and agents) from and against any and all claims, liabilities, costs, and expenses, including reasonable attorneys’ fees and costs, due to or arising in any way from the use or misuse by you of the Site and/or the Service, your violation of these Terms of Use, your violation of any law, or infringement by you of any right of any person or entity. You shall not settle any such claim without the prior written consent of e-TeleQuote.

Existing Insurance Coverage

Do not cancel any existing insurance prior to receiving written confirmation from the insurance company to which you are applying that your new policy is in effect.

Other

If any provision of these Terms of Use is found to be invalid or unenforceable, the other provisions shall remain in full force and effect, and such provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain valid and enforceable. These Terms of Use constitute the full understanding between you and us. You agree that any claim arising from or related to the Service, the Site and/or these Terms of Use must be filed within twelve (12) months of your use of the Service or the Site, regardless of any statute or law to the contrary.

All new versions of these Terms of Use automatically take effect when they are posted on this page, and your continued access and use of the Site after a new version is posted is deemed acceptance of those changes. You are responsible for periodically visiting this page to check for any changes and review the then-current Terms of Use. Checking the “Last Updated” date at the bottom of these Terms of Use allows you to determine if these Terms of Use have been revised since the last time you reviewed them.

(“e-TeleQuote”), an affiliate of Primerica, Inc., does business as easyMed Insurance Services in all states other than New Mexico. e-TeleQuote is a duly licensed insurance agency appointed by Medicare Advantage HMO, PPO and PFFS plans and stand-alone prescription drug plans and insurance companies holding Medicare contracts approved by The Centers for Medicare & Medicaid Services (CMS). e-TeleQuote is not connected with or endorsed by the U.S. Government or the Federal Medicare Program. Enrollment in any plan for coverage is subject to insurance company approval. Enrollment in the plan depends on the plan’s contract renewal with Medicare. By using e-TeleQuote’s easyMedicare website, you understand and agree that in New Mexico, we operate as e-TeleQuote Insurance, Inc. (Your IP address and/or location coordinates may be gathered to verify your location.) Sales agents may be compensated based on your enrollment in a health plan. Medicare Supplement plans are not connected with or endorsed by the U.S. Government or the Federal Medicare program. e-TeleQuote complies with applicable Federal civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability, sex, sexual orientation, gender identity, or religion. easyMedicare.com is a non-government site, powered by e-TeleQuote Insurance, Inc. e-TeleQuote provides a secure way to purchase Medicare insurance from the comfort of your home or workplace. We do not offer every plan available in your area. Currently we represent 5 organizations which offer 3,291 products in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-Medicare (TTY users should call 1-877-486-2048) 24 hours day/7 days a week, or your local State Health Insurance Program (SHIP), to get information on all of your options. Not all plans offer all of these benefits. Benefits may vary by carrier and location. Limitations and exclusions may apply. To send a complaint to Medicare, call 1-800-MEDICARE (TTY users should call 1- 877-486-2048), 24 hours a day/7 days a week). If your complaint involves a broker or agent, be sure to include the name of the person when filing your grievance.
